1. How to order ?

 

Check that you are using a recommended browser that accepts cookies. On our site to order products:

browse the online catalog on our website www.maisondarna.fr, then add the products of your choice to your basket. You can access the contents of your basket at any time before confirming the order, to proceed if necessary, to any modification of your choice (in particular deletion of the selected product or modification of the quantity of selected product), then from your basket click on "PAYMENT" to confirm your selection of product (s), select your delivery method and information relating to invoicing

then confirm your payment method.

Once the payment has been validated, you can then print your order form, if you wish.

In return, we will send you, by e-mail, an acknowledgment of receipt of your order on which will appear the number of your order and, as a reminder, the total amount to be paid.
Your order, once confirmed, is then taken in charge by the Customer Service which you can contact for any further information at the following coordinates:

Darna sarl reserves the right to cancel any order from a customer with whom there is a dispute over payment of a previous order or for any other reason relating to the abnormal nature of the order, at the discretion of Darna sarl.

In order to limit fraud and in the interest of its customers, Darna sarl checks the orders placed on its site. Thus, in case of doubt about the authenticity of a request, Darna sarl reserves the right, to accept the sale, to ask you to justify your identity (passport, national identity card or driving license). In this case, the processing of your order will be effected upon receipt of these documents. We reserve the right to cancel your order if we do not receive these documents within 10 days or if we receive documents deemed to be non-compliant.

 

2. Prices

 

The prices of our products indicated on our online catalog are in euros and include All Taxes included (excluding shipping costs). They take into account French VAT.

If the VAT rate changes, increases or decreases, this change may be reflected in the price of the items.

All shipping to France is invoiced including tax.

Any shipment outside of France, outside Monaco, and the European Union is invoiced after deduction of VAT.

Customs duties or other local taxes or import duty may be payable. These rights and sums are your responsibility, they will be indicated to you if necessary, at the time of delivery and will be payable directly to the carrier.

Our prices are subject to change at any time without notice, knowing however that the items ordered will be invoiced on the basis of the price in force at the time you pay for your order subject to the availability of the selected product.

 

3. Shipping costs

 

A contribution to the costs of packaging, insurance and shipping is requested for each order and is included in the delivery costs indicated before the validation of the order by you.

The delivery address taken into account is that indicated by you at the time of your order.
Delivery is made according to the delivery method chosen during the online ordering process. Please note: the perfume bottles are exclusively delivered by Fedex Express on French territory (excluding Corsica), due to their flammable nature.
Participation in packaging, insurance and shipping costs depends on the weight of the order and the country of destination. For online orders, this price will be indicated before the final validation of the order.

Note that it is more interesting to group all your articles on a single order. Please note, if you place two (or more) separate orders for the same delivery location on the same day, we will not be able to combine them and the shipping costs will be invoiced for each.

 

4. Delivery

 

Darna sarl reserves the right not to honor, in whole or in part, an order targeting a country in which there are specific local regulations.
In particular, given the existing regulatory limitations in the air transport of products with alcohol, orders for eau de parfum will only be accepted for the following countries: Metropolitan France (excluding Corsica).

Delivery times (= package preparation time + routing time)

For shipments in mainland France, Corsica and Monaco, the average delivery time is indicated below (depending on the delivery method chosen), knowing that the maximum legal delivery time is 30 days from the date of online purchase :

6 working days from confirmation of the order for Colissimo and Colissimo Withdrawal Points.

For deliveries to European Union countries and Switzerland, the average delivery time is 10 working days in Chrono Classic from the confirmation of the order.

However in case of "force majeure" we reserve the right to send our packages by registered parcel post (the shipping costs will, in all cases, calculated from the same price list).

For shipments to other countries, the average delivery time is 8 to 15 working days for Express shipments from the confirmation of the order.

Please note, these delivery times are given for information only and subject to the availability of items. In the event of a foreseeable extension of the shipping time, Darna sarl undertakes to inform the customer as soon as possible and by any means so that the latter can then choose whether to maintain or cancel the total or partial order. .

Darna sarl cannot be questioned and held responsible for the consequences of all events beyond its control, in particular cases of force majeure or arising from the carrier, which would tend to delay or prevent the delivery of the products ordered.

The delivery period may in no case result in the payment of damages for the benefit of the customer or the service providers thereof. Darna sarl reserves the right to split deliveries, it being understood that the participation in the shipping costs will only be invoiced for one shipment.

 

5. Payment

 

Payment is always made upon order before shipment of the goods. No discount for early payment is granted.

All orders, whatever their origin are payable in euros. Payment in stamps or cash is not accepted.

Attention, in the event that the payment is not equal to the total amount of the order, only the paid products will be dispatched.

Online payment by Credit Card (CB) via Stripe

You can pay for your order directly on our online store by CB via Stripe. During the final validation phase of your order you indicate the number of your credit card as well as its validity date and the cryptogram located on the back of the card (last 3 digits located on the signature panel). This information is entered in encrypted sections and all the information conveyed is coded. None of this information travels clear over the Internet.

Payment by check: You can send us a check in euros, payable in a French bank, payable to “DARNA SARL”. In this case, specify the date and the order number assigned to you online.

6. Products

 

The list of products presented on our site is not exhaustive.

The photographs illustrating our products are given for information only and are therefore not contractual.

Our products are available while stocks last. Darna sarl makes the best effort so that the products appearing as available for sale are actually in stock. However, in the event of a stock shortage after the final confirmation of your order, Darna sarl customer service will contact you within a maximum of 72 hours to inform you of products that are unavailable or whose shipment will be delayed and in this case, the estimated shipping time. In this case, you have the possibility:

- cancel your order completely,
- partially cancel your order and choose

- to receive the products initially available and the products to be sent later, as soon as they are available again,

- to receive the entire order, a single shipment, when all the products ordered are available.


If necessary, Darna sarl will reimburse you the amount concerned within 14 days of your written notification of your wish to cancel all or part of your order.

 

7. Guarantees

 

- Right to retract

In the event that the product ordered does not suit you or was defective or did not correspond to your order, Darna sarl grants you a withdrawal period of 14 days following its receipt (legal deadline).

The withdrawal period expires 14 days after the day on which you, or a third party other than the carrier and designated by you, physically takes possession of the goods.

To exercise this right, you must within the abovementioned 14 day period notify us of your decision to withdraw from this contract by means of an unambiguous declaration (for example letter sent by post or electronic mail), by writing to :

For the withdrawal period to be respected, it is sufficient that you send your communication relating to the exercise of the right of withdrawal before the expiration of the withdrawal period.

In the event of withdrawal from you of this contract, Darna sarl reimburses you, without undue delay, the amount corresponding to the product subject to the withdrawal, including delivery costs in the event that the entire order (paid products and gifts ) will be returned (except for the additional costs arising from the fact that you have chosen, if applicable, a delivery method other than the less expensive standard delivery method offered by Darna sarl) and, in any event, to later 14 (fourteen) days from the day we are informed of your decision, written and unambiguous, to withdraw from this contract. Return costs are your responsibility.

You must return the object of the withdrawal in its packaging, in perfect condition, and provided with all its accessories if necessary to the following address, without undue delay and, in any event, no later than 14 (fourteen) days after you have communicated your decision to withdraw from this contract to us. This deadline is deemed to be respected if you return the goods before the expiration of the period of fourteen days, at your expense and via a suitable delivery method, to the following address:

The right of withdrawal cannot be exercised for orders relating to products which have been unsealed after delivery and which cannot be returned for reasons of hygiene or health protection (eg care products).

Darna sarl will reimburse using the same means of payment as for the initial transaction, unless expressly agreed to a different means; in any event, this reimbursement will not incur any costs for you.

- Legal guarantee of conformity for consumer goods

When acting as a legal guarantee of conformity, the consumer:
- has a period of two years from the delivery of the goods to act;
- can choose between repairing or replacing the goods, subject to the cost conditions provided for in article L.211-9 of the Consumer Code;
- is exempted from bringing proof of the lack of conformity of the goods during the six months following the delivery of the goods. This period is extended to twenty-four months from March 18, 2016, except for second-hand goods.

It is recalled that the legal guarantee of conformity applies independently of the commercial guarantee possibly granted.

The consumer can also decide to implement the guarantee against hidden defects of the thing sold within the meaning of article 1641 of the Civil Code and, in this case, he can choose between the resolution of the sale or a reduction in the price of sale in accordance with article 1644 of the Civil Code.

 

8. Responsibilities


Darna sarl recalls that unemancipated minors are unable to contract. Orders for minors must therefore be confirmed by the parental authority.

Darna sarl invites you to refuse any package that is damaged and to notify our Customer Service, in writing and in detail, of your reservations within 3 days by keeping proof of your writing. Otherwise, Darna sarl considers that you have received the products in a state giving you all satisfaction.

 

9. Your personal data


Your data is subject to processing intended for the relevant departments of the company Darna registered with the RCS of Saint-Brieuc under the number 87803473500018.

We are committed to protecting your privacy when using our site and ensuring the confidentiality of the personal information you provide to us. This information is necessary for proper processing and tracking of orders. When you place an order, we must know your surname, first name, personal address; e-mail and mobile number for tracking the shipment of your packages. These data allow us to process your orders and to inform you about their status. Please note that we do not store your bank details.

Your data is collected with your consent to allow the sending of our offers by email or sms; of our catalogs and samples by mail. They will be kept for a maximum of 3 years after your last response to our requests. The legal basis for this processing is your consent, which you can withdraw at any time, without prejudice to the lawfulness of the processing carried out before this withdrawal.

In accordance with the General Data Protection Regulation n ° 2016/679 of April 27, 2016, you have the right to ask Darna sarl for access, rectification, portability and / or erasure of your personal data, as well as to limit the processing of these and to oppose their processing. You also have the right to lodge a complaint with the CNIL https://www.cnil.fr/.

10. Applicable law


These CGV are modifiable at any time. The new general conditions of sale will apply only to sales made after the modification.
French law is applicable and any difficulty or dispute will fall under the exclusive jurisdiction of the courts.
